Jared Fogle sentencing hearing set for Nov. 19
Former Subway pitchman faces a minimum of 5 years in prison on charges of possessing and distributing child pornography and having sex with minors.
Jared Fogle, who has agreed to plead guilty to child pornography charges and having sex with minors, will have his sentencing hearing Nov. 19.
The hearing will be at 9 a.m. that day before U.S. District Court judge Tanya Walton Pratt.
Under federal law, Fogle, the former Subway restaurant pitchman, faces a minimum of five years in prison. As part of a plea deal, prosecutors have agreed not to seek a sentence of more than 12-1/2 years.
Pratt, however, can sentence Fogle to up to 50 years.
In the federal system, prisoners must serve at least 85 percent of their sentence.
A pre-sentencing report will examine a wide range of factors in Fogle's life, from his education and personal conduct to any mental or physical issues he may have. That report will be submitted to the judge for consideration at sentencing.
"Jared Fogle is agreeing to plead guilty to the charges filed against him today," Fogle's lawyer, Jeremy Margolis, said Wednesday. "In doing so, Jared is accepting responsibility for what he has done. He is also volunteering to make restitution to those affected by his deplorable behavior. While Jared fully recognizes that such monetary contribution will not undo the harm he has caused, he is hopeful it will assist these individuals as they try to move forward with their lives.
"Jared also understands that he requires significant psychiatric medical treatment and counseling. He has already begun that process by being extensively examined by a world-renowned expert in sexual conditions in order to chart a course to recovery. It is Jared's intent and goal to become healthy again."
