A mother and son accused of plotting to murder a divorce attorney failed to appear at an initial hearing Friday in Hamilton County and are on the lam.

Renee Perillo, 51, Panama City, Fla., and Richard Perillo, 21, Laughlin, Nev., are wanted on a host of charges, including conspiracy to commit murder, theft, carrying a handgun without a license, possession of paraphernalia, criminal trespass, and unauthorized entry of a motor vehicle.

A probable cause affidavit filed Friday alleges that the two traveled to Noblesville and conspired to kill attorney Rebecca Eimerman. Eimerman was pursuing unpaid settlement money from Dr. Arnaldo Trabucco in a divorce case on behalf of his ex wife. Renee Perillo is dating Trabucco.

Eimerman could not immediately be reached for comment.

A woman who answered Trabucco's phone with an Arizona area code said he was in critical condition following an infection he had suffered and was in an intensive care unit. She declined to say where.

Police had Renee and Richard Perillo in custody May 22 on lesser charges after arresting them outside Eimerman's home but released the pair on $20,000 bonds May 23. Trabucco paid the bonds, the affidavit said.

Hamilton County Prosecutor Lee Buckingham said his office needed more time following the initial arrest to investigate and charge the two in connection with the murder scheme. His office planned to charge the two at their initial hearing Friday , but they failed to appear in court.

Asked why his office didn't ask for a higher bond as they pursued a murder case, Buckingham said he couldn't address that at this time.

Police initially arrested the two in the back of a Chevrolet Suburban parked at Eimerman's home May 22 in Noblesville. Her husband got into the SUV, saw the two in the back cargo area and called police.

The two, who were still in the SUV when police arrived, claimed to be homeless, according to the affidavit. But they were found with a full syringe, which they said contained heroin for their own use, and a Glock handgun. They also had several of Eimerman's identification and credit cards, which she had left in her wallet in the SUV.

Richard Perillo then changed his story as police pressed them, instead saying the two were camping in the area and hoped to persuade Eimerman to drop a legal action against his mother's boyfriend, according to the affidavit.

After the two were booked in the Hamilton County Jail, police continued to investigate. Richard Perillo bragged to a fellow inmate of coming to Noblesville to kill a local attorney, according to the affidavit.

Forensic examinations showed the syringe contained a lethal dose of a drug used in anesthesia called succinylcholine, rather than heroin. The handgun was registered to a Nevada man who said he sold it to Trabucco, according to the affidavit.

Police searched Renee Perillo's phone and found multiple Google searches of Eimerman and her home, the affidavit said. The phone contained photos of Eimerman's home and her SUV.

Police found a white Toyota Avalon parked near Eimerman's home that looked like it was being lived in, according to the affidavit. While it was owned by a Florida management company, it was insured by Trabucco. It had a stolen license plate, the affidavit said.

The two are wanted on a warrant.
